Getting nervous

    ok so I knew my boss was getting someone to replace me while I'm out but I'm kinda nervous now the guy is here and everyones acting wierd and they have the guy behind closed doors...I think they might gonna be firing me......but if they do I can get unemployement til I find a new job right?

    I am thinking that legally they cannot fire you due to pregnancy. You simply need to come right out and ask what is going on, see if you can be of assistance in training this person. You don't need the added stress at all.

    I agree with Rebecca. I don't think they can fire you. :hug99: I'm sorry that your job is adding so much stress to your life, it's just not fair. I hope you do ask them so you can relax a bit.

    yeah I know they can't til after my 12 weeks FMLA run out but I'm just worried they will let me go after the 12 weeks and not going to work with me like they said.....they are the kind if they can save a penny they will do it....

    I didn't think they could fire you either.

    I don't know, but I think I would personally start looking for other job opportunities that suited my time schedule for when I was ready to go back to work instead of worrying about the limited time. I hope things work out great for you. . .

    Maybe.... but.... remember know when preg. we notice/read more into things more than normal. I know I am WAY more emotional and paranoid than normal!

    Realize they may not be taking about firing you. There could be a million reasons for the closed doors and acting uneasy. Maybe they are talking to him about being sensitive to you because of of your concerns. Maybe they are worried that you won't come back after and are asking him if he would want the job full time if you don't come back. Maybe they are worried that you won't be able to help with the guys training and asking him how much supervision he needs.

    I'd do as the other person suggested and be as sweet and helpful as possible, and ask directly in a nice, sweet,, un-confrontational way (not 'are you firing me') but you need to be careful because acting nervous can go against you

    No, they can't fire you for being pregnant, but they CAN fire you for fire-able reasons. Do you work at an at will state?

    If they fire you for a fire-able offense and they put it in the paperwork you can't collect unemployment. But, if they fire you but put it as a lay-off on the paperwork, or 'lay you off' (which many companies do, and give new people different titles) you can. Each state is different as far as how long you can collect unemployment.

    If they fire you for a non- firable reasons they could have a lawsuit on their hands, so I doubt that is what they will do. Even if they do they likely won't (at least until you get back) because you are preg. and they would likely be worried about legal implications.

    I know it's scary, but really, unless you know for sure there are a million reasons they could be secretive! For all you know, they guy could be just released from prison or something and they don't want to scare people, lol

    Unemployment is tricky. My position was eliminated while I was on maternity leave, I had no job to come back to, and then unemployement wouldnt give me money until 6 weeks after I had the baby. It was a few months of hell. I got a job before I ever got my unemployement.

    I hope that is the case for your sake. BTW, what state do you work in?

    And you are right, but the things you CAN do is ask what is going on, and do your best to be the most stellar, helpful, sweet, easygoing employee... leave them with the best memories of you, and make them believe they couldn't possibly survive without you :D. At the very worst, what would happen if you accomplish that but it ends up not working out is excellent references and perhaps other job leads. At the best, they will be calling you begging you to come back to work earlier :D

    I agree with one of the pp's here: They can not fire you for being pregnant but they certainly can fire you for other reasons. Have you taken a lot of time off lately? I know that you have been talking to them about your leave. If you have formally requested more than your alotted 12 weeks off (combined with any time you have already taken this year), they can fire you for that. Even if you haven't they really can find something, if they really want to. How much time have you taken off in the last 12 months? Have you been on probation at all? When is your next performance review? How long have you been with the company?

    99 out of 100 times if someone feels that people are now treating them differently at work, they are absolutely correct. Pregnancy or no pregnancy.

    I'm sorry that you are going through this. It is unfortunate.

    Momoftheforest: Your state doesn't allow for disability during maternity leave?
    It is my understanding that even if your position is eliminated they are still obligated to offer you a position at the same pay rate even if it is not the original position (they do NOT have to have YOUR position when you come back... They could make you janitor if they wanted so long as your pay was the same). Sounds like you got a seriously raw deal.

    I've hardly ever take time off and if I do it's cause I'm really sick and maybe a total of 2 weeks in the past 4 years I've worked here....my reviews are always good and I always get my raises....I just hope I'm over reacting but the guy to do my job while I'm gone will be here Wednesday....
